Republicans react to Gov Palin’s announcement. Of course the timing is suspicious – or barryesque. Remember that  “report” about his staffers’ dealings with Blago? How conveniently was that released? John Edwards finally coming out after barry goes to Hawaii? But when Palin does it it’s “inept”.

One of those cowardly anonymous Republican sources:

it was a “calculation” she made that “it was time to move on.” The governor’s “book deal and other issues” were “causing a lot of friction” in her home state, the source said, adding that he believes she is “mapping out a path to 2012.”

Another one:

[Palin] thinks she has accomplished goals she has set forward. … She sees what a positive influence she has had on people’s lives from traveling the country in the last year.

RANDY RUEDRICH CHAIRMAN ALASKA GOP, RANDY RUEDRICH:  he “was not even contemplating her stepping down.”

CNN Republican strategist ED ROLLINS: Palin is “terribly inept.”

I think everyone is shocked by this, and I think to a certain extent everyone is going to assume there’s another story. You don’t just quit with a year and a half to go. You certainly don’t do this as a stepping stone to run for president. You finish the job that you’re in, and obviously she’s not doing that.

I think people are going to be very suspicious because of the timing. You don’t quit on the Friday of a three-day holiday. If you are going to do this, you think it through, you give a good speech.

CNN Republican Strategist MARY MATALIN:

Her delivery was incredible, if you’re a less charismatic person, you probably couldn’t pull it off. [Now] she will be freed up and liberated the way Mitt Romney is to raise money and get political chips by spending it and getting political capital. And she is still raising the kinds of crowds and money she always did.

We presume if there was anything else we would know it by now.

“We”? She was surprised by the announcement itself. The arrogance of these folks is amazing.

LT GOV SEAN PARNELL:

You know, I was surprised at first, and didn’t understand, because I think the traditional political thing to do is to stay in a position like that, and then, you know, leverage it into something greater. But that’s not Sarah Palin,” he said, praising her “independent streak.” “She is a real person with real dreams for real people, and when she believes she can effect better change for others through other means, she’s just going to do that.

GOV PALIN SPOKESWOMAN MEGHAN STAPLETON:

When the former Republican vice presidential candidate returned to Alaska after the campaign and pressed her agenda, “she found…resistance, and she found as she looked up more and more that state time and resources were being just wasted with just frivolous ethics complaints coming in, and FOIA (Freedom of Information Act) requests and lawsuits — but to an extraordinary extent, and from literally those doing opposition research. And so she said really, is this good for Alaska? Is this what a governor is supposed to do, sit and watch money going down the drain?

…I know you want to put that sort of negative word in there, but it’s not a ‘liability’ — it’s that she has a vision for the state…the best way and the best place to effect change at this point is outside her role as governor, because as governor people are just focused on bringing her down rather than building up the state, and that’s not who she is.

RNC CHAIRMAN MICHAEL STEELE STATEMENT:

I plan on talking to Governor Palin very soon. She is an important and galvanizing voice in the Republican Party. I believe she will be very helpful to the Party this year as we wage critical campaigns in Virginia and New Jersey. I am certain this has been a difficult decision for her to step down as Alaska’s governor. She has been a good governor for her state and I wish her and the Palin family the best during this transition.

MITT ROMNEY:

I wish Sarah Palin and her family well, and I know that she will continue to be a strong voice in the Republican Party.

While we regret the news announced by Governor Palin today, Alaska will continue to have a Republican governor through 2010 and we are confident the state will elect a Republican in next year’s election.

The RGA’s focus remains firmly on the gubernatorial elections in New Jersey and Virginia this year, and the 37 gubernatorial elections that will take place in 2010. We know that winning these races is the most important task facing our Party over the next two years.

Too weird for words. Gov Palin has decided not to run for re-election as governor of Alaska. She will be leaving office July 26 at the Governor’s picnic after swearing in Lt Governor Sean Parnell.

I’ve read her statement three times and am not any more enlightened than when I started. It’s probably just the dyslexia but the CAPITALIZATION and !!! and 2500 words were too much to focus through. Not commenting on her intelligence or statement-writing skills. The tone seemed off. Like she is excited — when someone who so loves their state should have some sadness. Overly excited to cover for something that’s coming? Making it sound like it’s her choice when it really isn’t?

No idea.

A summary of what I could grasp [emphasis added]:

Greetings to Alaskans, Seward’s Folly, what a great state Alaska is with natural resources, God gave us energy

People who know me know that besides faith and family, nothing’s more important to me than our beloved Alaska.

…recitation of accomplishments – including breaking ground on the new prison, stimulus, the debt being passed on to next generation, Alaskans should get more positive press — won 2 SCOTUS rulings…

Some say things changed for me on August 29th last year – the day John McCain tapped me to be his running-mate – I say others changed.

…her new ethics law used against her after barry’s attack dogs descended in Wasilla, 15 ethics violation investigation – not guilty in all, cost the state $2M to fight, personal debt $500K, not going to be a lame duck, will spend time helping others help Alaska…

If I have learned one thing: LIFE is about choices!

And one chooses how to react to circumstances. You can choose to engage in things that tear down, or build up….Productive, fulfilled people determine where to put their efforts, choosing to wisely utilize precious time… to BUILD UP.

And there is such a need to BUILD up and FIGHT for our state and our country. I choose to FIGHT for it! And I’ll work hard for others who still believe in free enterprise and smaller government; strong national security for our country and support for our troops; energy independence; and for those who will protect freedom and equality and LIFE… I’ll work for and campaign for those PROUD to be American, and those who are INSPIRED by our ideals and won’t deride them.

Sounds like she’s starting her own party.

I WILL support others who seek to serve, in or out of office, for the RIGHT reasons, and I don’t care what party they’re in or no party at all. Inside Alaska – or Outside Alaska.

But I won’t do it from the Governor’s desk.

Does this sound like it was her choice?

With this announcement that I am not seeking re-election… I’ve determined it’s best to transfer the authority of governor to Lieutenant Governor Parnell; and I am willing to do so, so that this administration – with its positive agenda, its accomplishments, and its successful road to an incredible future – can continue without interruption and with great administrative and legislative success.

My choice is to take a stand and effect change – not hit our heads against the wall and watch valuable state time and money, millions of your dollars, go down the drain in this new environment. Rather, we know we can effect positive change outside government at this moment in time, on another scale, and actually make a difference for our priorities – and so we will, for Alaskans and for Americans.

Religion? Special needs foundation? Valuable state money and time to defend her in court? Something is looming. It cannot be those folks who think Trig is not her child. That is a crazy birth certificate issue.

I do not want to disappoint anyone with my decision; all I can ask is that you TRUST me with this decision – but it’s no more “politics as usual”.

Some Alaskans don’t mind wasting public dollars and state time. I do. I cannot stand here as your Governor and allow millions upon millions of our dollars go to waste just so I can hold the title of Governor. And my children won’t allow it either. ? Some will question the timing. ? Let’s just say, this decision has been in the works for awhile…

She references the millions it has cost to defend her thus far and makes a point of saying there were 15 ethics investigations and she was innocent…and so 1 out of 16 isn’t bad? This next statement makes clear – to me – that some pending litigation is coming – something that if she were to be found guilty it would disqualify her from being governor.

...I cannot stand here as your Governor and allow millions upon millions of our dollars go to waste just so I can hold the title of Governor. And my children won’t allow it either. ? Some will question the timing. ? Let’s just say, this decision has been in the works for awhile…

In fact, this decision comes after much consideration, and finally polling the most important people in my life – my children (where the count was unanimous… well, in response to asking: “Want me to make a positive difference and fight for ALL our children’s future from OUTSIDE the Governor’s office?” It was four “yes’s” and one “hell yeah!” The “hell yeah” sealed it – and someday I’ll talk about the details of that… I think much of it had to do with the kids seeing their baby brother Trig mocked by some pretty mean-spirited adults recently.) Um, by the way, sure wish folks could ever, ever understand that we ALL could learn so much from someone like Trig – I know he needs me, but I need him even more… what a child can offer to setpriorities RIGHT – that time is precious… the world needs more “Trigs”, not fewer.

Talks about the great sacrifice of the troops and her recent trip to Kosovo and Landstuhl.

Goes it sound like it hurts? She sounds relieved.

It hurts to make this choice but I am doing what’s best for Alaska….But I have given my reasons… no more “politics as usual” and I am taking my fight for what’s right – for Alaska – in a new direction….And I will support you because we need YOU and YOU can effect change, and I can too on the outside.

Republicans tell her to get lost?

We need those who will respect our Constitution where government’s supposed to serve from the BOTTOM UP, not move toward this TOP DOWN big government take-over… but rather, will be protectors of individual rights – who also have enough common sense to acknowledge when conditions have drastically changed and are willing to call an audible and pass the ball when it’s time so the team can win! And that is what I’m doing!

They’re in good hands with Lt Governor Sean Parnell. But what’ll be good and for whom?

Remember Alaska… America is now, more than ever, looking North to the Future. It’ll be good. So God bless you, and from me and my family – to ALL Alaska – you have my heart.

And we will be in the capable hands of our Lieutenant Governor, Sean Parnell. And Lieutenant General Craig Campbell will assume the role of Lieutenant Governor. And it is my promise to you that I will always be standing by, ready to assist. We have a good, positive agenda for Alaska.

Conclusion:

In the words of General MacArthur said, “We are not retreating. We are advancing in another direction.”

So what position has barry offered her??

And I can’t help but think there’s another ethics probe pending. Hope you get more out of it. Her tone was not that of mourning or regret but rather relief and false enthusiasm. Wonder if there’s a video. Her body language doesn’t need so many words.

This letter was in the comment section of the “Petition to POTUS to prevent Lt Dan Choi from being fired” post that I’ve been meaning to enter. It is an open letter from Vietnam Veteran, BILL STODDART to barry. I’m posting it because I think Mr Stoddart deserves to be heard and Lt Choi should get to hear his support and the chances are better in a main post than in the comment section. I don’t think Mr Stoddart would mind since his intent was to get his message to POTUS but I didn’t include his name in the title just in case.

Mr. President,

I served in the US military from 8/66 thru 8/69. One of these three years was with the 25th Infantry Division in Vietnam.

It just amazes me that the mere fact of my sexual orientation, even today, if discovered would prevent me from serving my country.

Because of low enlistment rates, the military continues to lower it’s applicant expectations. Today, even convicted felons are permitted to enlist. Yet a law abiding gay or lesbian American is not permitted to serve simply because of who they are.

The US stands alone as the only major world power that discriminates in this way. The “Don’t Ask, Don’t Tell” policy is just like the “Separate But Equal” policy of the 60’s and 70’s that promoted segregation. The Supreme Court ruled that the will of the majority should never be used to subject the rights of a minority and that “Separate But Equal” was inherently “unequal”.

The Pentagon is complaining that we don’t have enough qualified linguists serving in Iraq. Yet, within the last few years, a whole group of servicemen serving in Iraq (and fluent in Arabic) were discharged simply because of who they were.

I fully realize that there are many issues on your plate at this time. HOWEVER, how can we portray ourselves as the beacon of democracy in the world if we permit this type of blatant homophobia at home!!

Do what you promised to do Mr President and abolish “Don’t Ask Don’t Tell today!!

Has done nothing but promise to fix once the “generational gap” is taken care of….aka his need to pander to the Evangelicals. 3/4 Americans think DADT should be repealed and more than 100 retired admirals and generals support the repeal of DADT. Where is the generation gap? Where is the Commander in Chief?

Dear President Obama:

The United States of America prides itself on having the finest military in the world because of the hard work, dedication, and sacrifices of our brave servicemen and women.  And yet, under 10 U.S.C. § 654 (Policy Concerning Homosexuality in the Armed Forces), better known as “Don’t Ask, Don’t Tell,” the talents and contributions of our openly gay, lesbian, bisexual, and transgender (LGBT) service members continue to be ignored simply because of who they are.  Every day, we lose approximately two service members to this misguided, unjust, and flat-out discriminatory policy.  Don’t Ask, Don’t Tell is not only an injustice to them, but a disservice to the U.S. military and our country as a whole.

As you know, Don’t Ask, Don’t Tell was signed into law in 1993 by former President Bill Clinton as a compromise to allow gay and lesbian service members to serve in the military – so long as they did not disclose their sexual orientations.  Fifteen years later, Don’t Ask Don’t Tell is instead negatively impacting the lives and livelihoods of these military professionals and depriving our Armed Forces of their honorable service.  Since you took office on January 20, 2009, more than 250 gay and lesbian service members have been discharged under this law, which continues to undermine and demoralize the more than 65,000 gay and lesbian Americans currently serving on active duty.

Although we are confident that you will remain true to your campaign promise to end Don’t Ask, Don’t Tell, our LGBT service members and our country’s national security will continue to suffer if initial action is delayed until 2010 or 2011.  We urge you to exercise the maximum discretion legally possible in administering Don’t Ask, Don’t Tell until Congress repeals the law.  To this end, we ask that you direct the Armed Services not to initiate any investigation of service personnel to determine their sexual orientation, and that you instruct them to disregard third party accusations that do not allege violations of the Uniform Code of Military Justice. That is, we request that you impose that no one is asked and that you ignore, as the law requires, third parties who tell. Under your leadership, Congress must then repeal and replace Don’t Ask, Don’t Tell with a policy of inclusion and non-discrimination.  This bilateral strategy would allow our openly gay and lesbian service members to continue serving our country and demonstrate our nation’s lasting commitment to justice and equality for all.

As the United States continues to work towards responsibly ending the War in Iraq and refocus on the threat from al Qaeda in Afghanistan and Pakistan, our LGBT service members offer invaluable skills that enhance our country’s military competence and readiness.  Despite the great strain on our military’s human resources, the Armed Forces have discharged almost 800 mission-critical troops and at least 59 Arabic and nine Farsi linguists under Don’t Ask, Don’t Tell in the last five years.  This is indefensible.  The financial cost alone of implementing Don’t Ask, Don’t Tell from Fiscal Year 1994-2003 was more than $363.8 million. Our nation’s military has always held itself to the highest standards, and we must recruit and retain the greatest number of our best and brightest.  To do anything less only hurts our country’s military readiness and our service members.

We also want to bring to your attention the most recent examples of the failed Don’t Ask, Don’t Tell policy in action.  New York National Guard First Lieutenant Dan Choi and Air Force Lieutenant Colonel Victor Fehrenbach are two exceptional servicemen who have dedicated their lives to defending our country and protecting the American people.  Their bravery and abilities have been tested in combat, and now they face impending discharge under Don’t Ask, Don’t Tell.

First Lieutenant Choi, a current National Guardsman with the 1st Battalion of the 69th Infantry in Manhattan, is a West Point graduate, Arabic language specialist, and Iraq War veteran who is under investigation for refusing to lie about his identity.

Lieutenant Colonel Fehrenbach, Assistant Director of Operations for the 366th Operations Support Squadron at Mountain Home Air Force Base in Idaho, has honorably served his country for 18 years as an F-15E pilot.  He has received nine air medals, including a Medal for Heroism during the 2003 invasion of Iraq, and was hand-picked to protect the airspace over Washington, D.C. after the Pentagon was attacked on September 11, 2001.  Lieutenant Colonel Fehrenbach, who has flown combat missions in Iraq and Afghanistan against the Taliban and al Qaeda, continues to serve while the recommendation for his honorable discharge moves forward to a review board, and eventually to the Secretary of the Air Force.  Just two years away from his 20-year retirement, he stands to lose $46,000 a year in retirement and medical benefits for the rest of his life if discharged.

The American people and service members of the Armed Forces overwhelmingly support the repeal of Don’t Ask, Don’t Tell.  According to a national Gallup poll conducted in May 2009, 69 percent of Americans, including 58 percent of Republicans, favor allowing openly gay men and lesbian women to serve in the military.  Furthermore, a 2006 poll of 545 troops who served in Iraq and Afghanistan by Zogby International and the Michael D. Palm Center at the University of California, Santa Barbara revealed that 73 percent are personally comfortable with gay men and lesbian women.  John Shalikashvili, former Chairman of the Joint Chiefs of Staff during the Clinton administration, and more than 100 retired admirals and generals support this repeal, in addition to the Human Rights Campaign, the Servicemembers Legal Defense Network, and Knights Out, an organization of LGBT West Point alumni co-founded by First Lieutenant Choi.

Mr. President, we cannot afford to lose any more of our dedicated and talented service members to Don’t Ask, Don’t Tell.  On behalf of First Lieutenant Choi, Lieutenant Colonel Fehrenbach, and the more than 12,500 gay and lesbian service members who have been discharged since Don’t Ask, Don’t Tell was implemented in 1994, we stand ready to assist you in repealing this dishonorable and debilitating law as soon as possible, and in restoring justice and equality in our Armed Forces.

Please know that we will continue to monitor this situation and are hopeful that, together, we can address this urgent issue soon.  Thank you for your consideration and we look forward to your response.

Publisher nixes Gov Sanford’s book deal

Besides his wife and family, the first financial fall out is his publisher. Gov Sanford was writing a book about his policies that was due out March 2010. No more. Sentinel, the conservative division of Penguin publishing had already advertised it as “a manifesto about fiscal conservatism – why the government needs to spend less and fix the deficit ASAP.” One can see why he was rejecting the stimulus.

List of the Members of Congress who signed the letter to barry requesting that he “Suspend “Don’t Ask, Don’t Tell” and Initiate Bilateral Repeal Process”. Meaning no more investigations and discharge of service members in the Armed Forces because of their sexual orientation. He pretends he is powerless but as Commander in Chief they have to take his orders. Problem is he is too weak to do so. He feels it’s more politically expedient to avoid the gays in the military and the LGBT Community in general because of his need to pander to the Bible Belt. Phil Berg has put out a press release concerning his recent case [Berg vs. Obama, U.S. District Court, Case No. 08-cv-1933] that was “dismissed with prejudice”. It was initially a sealed case and was heard behind closed doors. It became unsealed once the judge dismissed it. The case was based on whether barry had defrauded the US Treasury by cashing his paycheck as a senator — since Berg alleges barry is not a citizen of the US — and therefore did not meet the requirement to be senator. Berg used the False Claim Act (aka Qui Tam):”When a person has knowledge that another party has obtained money from the Government based on a false claim.” It’s usually used in reference to Medicaid/Medicare fraud.

Holder kept delaying, no discovery was allowed, and it was dismissed. Berg evidently raised the issue of conflict of interest back then but it seemed not to have mattered, which is why I don’t understand the filing of a “motion for reconsideration”. Berg alleges the conflict of interest is personal (Holder gives barry advice and was a campaign advisor and part of the VP search committee) as well as financial (paycheck) backing it up with Constitutional statutes.  I’m not sure how this is going to be allowed to proceed — I was under the impression that “with prejudice” meant he could no longer pursue it. I guess this is considered an appeal.

*Interesting factoid I was not aware of – barry never resided at the address on the birth announcement.

Obama and Berg has filed a Motion for Reconsideration.

(Washington, DC – 07/02/2009) – Philip J. Berg, Esquire, the first Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of Constitutional “qualifications/eligibility” to serve as President of the United States and his cases that are still pending in Federal Court, Berg vs. Obama [Third Circuit Court of Appeals No. 08 – 4340]; this case - Berg as Relator v. Obama; [U. S. District Court for the District of Columbia No. 08-cv-01933]; and Hollister vs. Soetoro a/k/a Obama, et al [U.S. Court of Appeals for the District of Columbia, No. 09-5080]; announced today that he filed a Motion for Reconsideration in the Qui Tam [False Claims Act] Case filed in the U.S. District Court, District of Columbia as United States Attorney General Eric Holder and his Office have a Conflict-of-Interest and inasmuch violated both the Federal Regulations as well as Federal Criminal Codes. U.S. Attorney General Eric Holder, his Office, his Staff and the United States Department of Justice are required to uphold and ensure our laws; the laws of the United States are upheld and enforced.

Article II, Section 3 of the U.S. Constitution states:

“The Constitution entrusts the Executive with duty to take Care that the Laws be faithfully executed.”

PHIL BERG:

The request of the Government to Dismiss his Qui Tam action against Barry Soetoro a/k/a Barack H. Obama is in clear violation of the U.S. Attorney General’s duties pursuant to Article II, Section 3 and should ‘NOT’ be allowed.

I furnished the Government and the Court with the information as to Barry Soetoro a/k/a Barack Hussein Obama’s legal name, which is Barry Soetoro and his citizenship status as Indonesian; I furnished sworn Affidavits showing Barry Soetoro a/k/a Barack Hussein Obama was born in Mombosa, Kenya; I presented evidence that the Certification of Live Birth [COLB] presented on the internet by Barry Soetoro a/k/a Barack Hussein Obama has been deemed a forged and altered document; I presented evidence that the birth announcement filed in the Hawaiian newspapers regarding Barack H. Obama on or about August 13, 1961 could not be verified; I presented evidence Barry Soetoro a/k/a Barack Hussein Obama never resided in the address on the birth announcement; and I raised the genuine issues pertaining to Barry Soetoro a/k/a Barack Hussein Obama’s college records wherein Berg is informed, believes and therefore alleges Barry Soetoro a/k/a Barack Hussein Obama attended Occidental College in California and Columbia University in New York and Harvard Law School as a foreign student.

None of which have been refuted by the Government.

Instead of investigating the true issues,
the Government through the United States Attorney General Eric Holder, his staff and the United States Department of Justice, who U.S. Attorney General Eric Holder also over-sees moved to Dismiss the Qui Tam action instead of upholding our United States Constitution and the very laws stated to protect “we the people” from any individual usurping the Office of the President of the United States.

Berg’s Qui Tam was regarding the U.S. Senator Position from Illinois held by Barry Soetoro a/k/a Barack H. Obama and the salary and benefits Obama drew based on fraudulent claims. This is a very unique situation as Barry Soetoro a/k/a Barack Hussein Obama is now our acting President of the United States. President Obama appointed Eric Holder for the position of the United States Attorney General and Mr. Holder reports directly to President Obama. This creates a huge Conflict-of-Interest with anyone from U.S. Attorney General Eric Holder’s Office having any association with the Qui Tam matter against, now, President Obama.

There are Federal Statutory prohibitions and related regulations addressing Conflicts-of-Interest on the part of present officers or employees of the Federal (and in some instances of the District of Columbia) government.

The Code of Federal Regulations (CFR), 5 CFR § 2635, et seq. and 5 CFR § 2640, et seq. governs Governmental Employees, including U.S. Attorney General Eric Holder and his staff.

5 CFR § 2635.101 states in pertinent part,

“(a) Public service is a public trust. Each employee has a responsibility to the United States Government and its citizens to place loyalty to the Constitution, laws and ethical principles above private gain.

In addition to the standards of ethical conduct set forth in the Code of Federal Regulations, there are Conflict-of-Interest statutes that prohibit certain conduct. Criminal Conflict-of-Interest statutes of general applicability to all employees, 18 U.S.C. §§ 201, 203, 205, 208, and 209, are summarized in the appropriate subparts located in these chapters and must be taken into consideration in determining whether conduct is proper.

As to the restrictions on Conflicts-of-Interest during government service, only Section 208 is illuminated by formal regulations, which are found in the Code of Federal Regulations (CFR).

5 CFR. § 2640.103 “Prohibition” states:

“(a) Statutory prohibition. Unless permitted by 18 U.S.C. 208(b) (1)–(4), an employee is prohibited by 18 U.S.C. 208(a) from participating personally and substantially in an official capacity in any particular matter in which, to his knowledge, he or any other person specified in the statute has a financial interest, if the particular matter will have a direct and predictable effect on that interest. The restrictions of 18 U.S.C. 208 are described more fully in 5 CFR 2635.401 and 2635.402.

PHIL BERG:

U.S. Attorney General Eric Holder has a financial interest as does his staff as they draw their income from the Government who is over-seen by Barry Soetoro a/k/a Barack H. Obama.

Eric Holder joined President Obama’s presidential campaign as senior legal advisor and also served as one of three [3] members on Obama’s vice-presidential selection committee.
In December 2008, then President-elect, Obama asked Eric Holder to serve in his cabinet as the U.S. Attorney General. Mr. Holder was appointed by President Obama and now serves as the United States Attorney General; is the head of the United States Department of Justice and United States Attorney General’s Office. Eric Holder is paid by the United States Government and reports directly to President Obama. Eric Holder has a direct financial interest in that he draws a salary based on his position as United States Attorney General. This Conflict-of-Interest goes beyond financial. The United States Attorney General is the Chief Law enforcement officer of the Federal Government and represents the United States in legal matters and gives advice and opinions to the President of the United States.

[Conflicts-of-Interest include but are not limited to a financial interest; a personal interest; improper business practices; etc.]

It is clear U.S. Attorney General Eric Holder and the staff in which he supervises have a huge Conflict-of-Interest as they have financial interests as well as personal interests which limits them from doing their job as required pursuant to the United States Constitution and therefore, Attorney General Eric Holder should recuse himself and/or designate Relator Philip J. Berg to proceed.

I am not giving up and am continuing my legal fight to prove Obama is not constitutionally qualified/eligible to be President of the United States. I am proceeding for the 305 + million people in ‘our’ U.S.A., for ‘our’ forefathers and for the 1.5 million men and women that have died defending our Constitution in the many wars over the years and the 1.5 million men and women who were injured in those wars.

Lou Pinella on getting “ejected”

Cubs’ skipper, Lou Pinella, known for his dramatic ejections was ejected for the first time last game. He has been getting a lot of heat on talk radio — especially WGN — for his passivity – that he’s “lost his fire” and how he has said in the press conferences that there’s nothing he can do. Well, to start he told Milton Bradley to go home the other night after his tantrum against the SOX. And now he’s sitting Soriano – the other sore point. So it appears he’s listening to frustrated Cubfans. Wish he would have listened to us about Mark DeRosa.

Anyway he got ejected last night because he knew he was coming home to face the press. In today’s pre-game press conference, they made note of the fact that this was the longest he had gone without being ejected – since last season.

Reporter:

Do you know that it’s been 11 months since your last ejection?

Lou deadpanned:

“My wife ejected me a couple of times this winter.”

Herr Olbermann speaks out against barry as far as Don’t Ask, Don’t Tell. He brings up the obvious point that needs to be hammered at. barry is Commander in Chief. They have to follow his orders. He doesn’t need to wait for a “generational gap” to pass. He doesn’t have to wait until Congress changes things. He can stop discharges. He can suspend investigations. He can make a stand. But he won’t. The gay community has always been expendable to him and they saw that with DOMA. [Secretary Clinton led the way in getting same sex partners benefits.] The polls are in his favor – but his panderment takes precedent. The value of gaining more barryfans is greater than the chance of losing the LGBT community — because where are they going to go?

What’s Rachel Maddow saying lately – other than blaming “birthers” for that crazy man who killed at the Holocaust Museum? Have to repost that video – unfortunately it was hand transcribed and no way I’m doing that again.

OLBERMANN: Marking the anniversary of the modern gay rights movement in front of those now fighting for it, the president likened the struggle to past civil rights battles, then listed his administration‘s accomplishments towards achieving equality, with one exception, repealing Don‘t Ask, Don‘t Tell. In our third story, four decades after the Stonewall riots, the president faces criticism that he is stone-walling.  In the East Room, Mr.  Obama telling members of the gay community and their families, welcome to your White House.  Then addressing the elephant in the East Room, the 16-year-old policy banning gays from openly serving in the military.

OBAMA:  I believe Don‘t Ask, Don‘t Tell doesn‘t contribute to our national security.  In fact, I believe—I believe preventing patriotic Americans from serving their country weakens our national security.

OLBERMANN:  And while Mr. Obama also pledged to work with the Pentagon and Congress to repeal the policy, the commander in chief gave no firm time line.  Lieutenant Colonel Victor Fehrenbach, one of those discharged under Don‘t Ask, Don‘t Tell, attended the ceremony last night, and spoke with the president.

VICTOR FEHRENBACH, DISCHARGED FROM ARMY THROUGH DON‘T ASK DON‘T TELL:

[Look at this man's resume and ask yourself why his sexual orientation matters. Do you know they take convicted felons in the army? I hope Lt Col Fehrenbach doesn't let barry rest on this. A look in the eye doesn't mean much from barry. How many times did he look The American People in the eye about Iraq?]

FEHRENBACH: He looked at me right in the eye and he said, we are going to get this done.  And then he continued to say, you know, everyone seems to be on board with it.  We have about 75 percent of the public that supports this.  What we have is a generational issue, so there‘s some convincing to do, that there‘s a generational gap, it seems, in some of the senior leadership.

[Why can't barry be honest just for once? Why does the C-I-C have to "convince" anyone?]

OLBERMANN:  Earlier tonight, a military board recommending that Lieutenant Dan Choi, an Iraq war veteran Arabic linguist, be discharged from service.  If that recommendation holds, Choi will become the 266th service member to fall victim to Don‘t Ask, Don‘t Tell since President Obama took office in January. Joining us now is activist Dan Savage, author of “The Commitment: Love, Sex, Marriage and My Family.” Thanks for some of your time tonight, sir.

DAN SAVAGE, ACTIVIST:  Thank you for having me, Keith.

OLBERMANN:  Is it times like this where the president needs to be reminded he‘s also commander in chief of the military?  Is there an argument to be made that he can‘t somehow use that authority to end this process?

SAVAGE:  There is an argument to be made.  And last week, 78 members of the Congress made just that argument in a letter to the president to encouraging to use his authority as commander in chief to suspend enforcement of Don‘t Ask, Don‘t Tell, and end the discharges of gay and lesbian service members like Choi and Fehrenbach.  He has that authority. You see over at the Department of Homeland Security, Janet Napolitano has used just that authority to suspend enforcement of something called the widowers penalty, which is a law that requires people who have been married to a U.S. citizen for less than two years, whose spouse dies, to be deported.

Napolitano wants that law changed.  She thinks it‘s cruel and inhumane.  And she suspended enforcement while Congress, quote/unquote, works on a fix.  She seems to have authorities and powers that the president, her boss, commander in chief, does not?  It‘s really quite shocking that everyone in that room would applaud so politely when the president stood there and pretended like he couldn‘t end at least enforcement of Don‘t Ask, Don‘t Tell today, right now.

OLBERMANN:  What Lieutenant Colonel Fehrenbach said after the conversation he had with the president last night is that the president told him there was this generational gap to deal with.  But even the oldest man in the Army is not required to follow the orders of the president of the United States? What is—it feels like—does it not feel like this to you, being directly involved in this, and to me as sort of on the sidelines, that there‘s something that he‘s hinting at, that Obama is hinting that, that is just not getting through to anybody?

SAVAGE:  Well, he‘s the president.  He doesn‘t have to blink out distress signals.  He can issue orders.  Yes, there may be a generation gap.  There was a much bigger and wider and more problematic generation gap when Truman ordered the military to integrate racially.  If Truman had waited for everyone to be on board—the president himself said 75 percent of the country supports the end of Don‘t Ask Don‘t Tell. How many more retrograde bigots do we need to wait to come up to speed before the president moves at least on suspending Don‘t Ask, Don‘t Tell.  And then demanding that Congress repeal it.

OLBERMANN:  Is there—he said generational.  Is there also a religious thing going on here?  Is Obama coming up against the organized fundamentalists, proselytizers who look at the military and so these fertile fields for indoctrination among the new recruits, and, of course, the indoctrination of the more of these restrictive religions, components that include homophobia?

SAVAGE:  Perhaps.  Obama does seem to have kind of a hang-up when it comes to wanting to find common ground with the likes of Rick Warren and fundamentalist Christians, who are never going to see eye to eye with him on gay and lesbian issues.

If he is our fierce advocate, if he is our champion, as he described himself last night at the White House, he needs to stop pandering to religious conservatives.

Not all religious people oppose equal rights for gays and lesbians.  Many religious organizations and people have endorsed marriage equality and endorsed the appeal of Don‘t Ask Don‘t Tell.  The president needs to worry more about those religious people, and less about Rick Warren and his ilk.

OLBERMANN:  Was there any silver lining in this for you?  Did you see anything to suggest there‘s progress within the administration?

SAVAGE:  Well, we, once again, got a reiteration of the promises the president made to the gay and lesbian community.  We got them know as president, as opposed to as candidate Obama.  And there was tremendous symbolic value to what happened at the White House yesterday.  I don‘t want to discount that.

However, there‘s been very little action, very little progress. And what comes out of the president‘s mouth doesn‘t seem to translate into policy.  And we didn‘t—we got the promises when he was candidate Obama.

What we want now is actually we want the fierce urgency of now.  People are being discharged from the military now.  People are being turned away from their partner‘s bedsides during medical emergencies now.

We weren‘t sold the fierce urgency of maybe in my second term or I‘ll get to it or one day or wait, have patience.  We want these promises fulfilled now.

[barry took care of Gitmo on day one and yet has allowed 266 servicemembers to be discharged since that first day - including Arab linguists. He's a damn joke.]

OLBERMANN:  Yes.  On two levels, A, human rights and, B, by the way, we need all of the Arab linguists we can find.  I don‘t care what they look like, what they do, or who they are.  The president is god damned wrong on this. Dan Savage, author and activist, thank you for being here.

I wonder how many times a day that evil man’s name is said?

Did you wonder which one I was referring to?

AH of course.

A 66 y/o man in Highland Park (suburb far north of barry’s mansion) goes to the local post office. He sees a man and woman from Chicago holding up signs depicting barry with a AH mustache. (Not clear if AH’s name was also on the sign). They were protesting barry’s healthcare plan. The man has words with the couple and then leaves. Protesters go to local police station and allege the man made a threatening statement. Police call man – he returns – says he was agitated by the sign because he has relatives who in the Holocaust — Highland Park has a sizeable Jewish Community. The protesters decide to press charges and the man is charged with disorderly conduct and given a court date.

INTERVIEWER: Here is Susan Boyle on the 5:30 show – your welcome to the programme Susan. What a time its been for you so far – on Friday you were unknown to the British nation, now you’re an internet sensation… 2.5 million people have watched that clip so far. How do you feel?

MS BOYLE: Gobsmacked, absolutely gobsmacked.

What’s it been like on the streets of Blackburn?

Everybody is wanting my autograph. I’m telling you its really surreal.

What made you go in for this, because you’re a shy person. What made you push yourself forward for this?

Basically I wanted to fulfill a wish to my mother, I wanted to do something with my life. Not only that but I think I had a bit more to offer.

What did you do with your singing previously?

Basically in the choir, I’ve been in school productions, karaoke – you name it I was on it.

And when people heard you sing karaoke – had they said youve got to go on Britain’s Got Talent or one of those shows?

Well, they did mention it once or twice, and then I said to them well I’ll have a go at it now and see how far I get.

The judges loved you, the audience loved you – were you confident when you stepped out on that stage you would get a good reaction?

I didn’t know what kind of reaction I would get - I’m being honest with you. But I just got through with it you know. You just get on with it.

Because as your performance progressed everybody started to stand up – could you actually see that past the lights? Could you see that happening?

I couldn’t have – cos I had my eyes closed half the time.

Did you get a chance to chat to the judges afterwards?

No, I didn’t no. You don’t do that anyway – it’s not professional.

So where is this going to go, Susan – are you going to wait and see what happens? How far do you think you can go with this?

This letter is both profoundly courageous and profoundly sad – especially this:

When I receive emails from deployed soldiers and veterans who feel isolated, alone, and even suicidal because the torment of rejection and discrimination, I remember my leadership training: soldiers cannot feel alone, especially in combat.

Why should any American who volunteered to risk their life to help preserve our freedoms not be given the same freedoms?

How is DADT any different than the segregation of Black soldiers in WWII?

And why should 1Lt Choi, who has spent 10 years in the service, including two tours of combat in Iraq, have to beg the President and Congress not to fire him?

Open Letter to President Obama and Every Member of Congress:

I have learned many lessons in the ten years since I first raised my right hand at the United States Military Academy at West Point and committed to fighting for my country. The lessons of courage, integrity, honesty and selfless service are some of the most important.

At West Point, I recited the Cadet Prayer every Sunday. It taught us to “choose the harder right over the easier wrong” and to “never be content with a half truth when the whole can be won.” The Cadet Honor Code demanded truthfulness and honesty. It imposed a zero-tolerance policy against deception, or hiding behind comfort.

Following the Honor Code never bowed to comfortable timing or popularity. Honor and integrity are 24-hour values. That is why I refuse to lie about my identity.

I have personally served for a decade under Don’t Ask, Don’t Tell: an immoral law and policy that forces American soldiers to deceive and lie about their sexual orientation. Worse, it forces others to tolerate deception and lying. These values are completely opposed to anything I learned at West Point. Deception and lies poison a unit and cripple a fighting force.

As an infantry officer, an Iraq combat veteran and a West Point graduate with a degree in Arabic, I refuse to lie to my commanders. I refuse to lie to my peers. I refuse to lie to my subordinates. I demand honesty and courage from my soldiers. They should demand the same from me.

I am committed to applying the leadership lessons I learned at West Point. With 60 other LGBT West Point graduates, I helped form our organization, Knights Out, to fight for the repeal of this discriminatory law and educate cadets and soldiers after the repeal occurs. When I receive emails from deployed soldiers and veterans who feel isolated, alone, and even suicidal because the torment of rejection and discrimination, I remember my leadership training: soldiers cannot feel alone, especially in combat. Leaders must reach out. They can never diminish the fighting spirit of a soldier by tolerating discrimination and isolation. Leaders respect the honor of service. Respecting each soldier’s service is my personal promise.

The Department of the Army sent a letter discharging me on April 23rd. I will not lie to you; the letter is a slap in the face. It is a slap in the face to me. It is a slap in the face to my soldiers, peers and leaders who have demonstrated that an infantry unit can be professional enough to accept diversity, to accept capable leaders, to accept skilled soldiers.

My subordinates know I’m gay. They don’t care. They are professional.

Further, they are respectable infantrymen who work as a team. Many told me that they respect me even more because I trusted them enough to let them know the truth. Trust is the foundation of unit cohesion.

After I publicly announced that I am gay, I reported for training and led rifle marksmanship. I ordered hundreds of soldiers to fire live rounds and qualify on their weapons. I qualified on my own weapon. I showered after training and slept in an open bay with 40 other infantrymen. I cannot understand the claim that I “negatively affected good order and discipline in the New York Army National Guard.” I refuse to accept this statement as true.

As an infantry officer, I am not accustomed to begging. But I beg you today: Do not fire me. Do not fire me because my soldiers are more than a unit or a fighting force – we are a family and we support each other. We should not learn that honesty and courage leads to punishment and insult. Their professionalism should not be rewarded with losing their leader. I understand if you must fire me, but please do not discredit and insult my soldiers for their professionalism.

When I was commissioned I was told that I serve at the pleasure of the President. I hope I have not displeased anyone by my honesty. I love my job. I want to deploy and continue to serve with the unit I respect and admire. I want to continue to serve our country because of everything it stands for.

Please do not wait to repeal Don’t Ask, Don’t Tell. Please do not fire me.

Lt Dan Choi was on CNN’s American Morning discussing the impending final decision as to whether he is dismissed from the Army simply because he said “I am gay.” A West Point Grad and Arab linguist, a man who served two combat tours in Iraq and wanted to do a third, is being thrown out of the Army for something that was born with him as much as heterosexuality was to the Commander in Chief.

How does the West Point code of honor square with the silence of Don’t Ask, Don’t Tell?

More than 12,500 gays and lesbians – including dozens of Arabic linguists — have been forced to leave the military since DADT went into effect. And estimated 65,000 LGBT are actively serving in the Armed Forces.

JOHN ROBERTS: Well, this morning, an update to a story that we first brought you in AMERICAN MORNING. U.S. Army First Lieutenant Dan Choi, a West Point graduate, an Arab linguist who is being forced out of the military because he’s openly gay. And President Obama still has not moved on a campaign promise on getting rid of the “don’t ask, don’t tell” policy in the military.
Tomorrow, Choi is scheduled to appear before an Army retention board to make his case on why he should not be discharged.

Joining us now from San Francisco is Lieutenant Dan Choi. Dan, it’s good to talk to you this morning. Thanks for the update. What do you plan to tell the retention board tomorrow?

LT. DAN CHOI, BEING DISCHARGED FOR BEING GAY:

Well, I originally thought that I would open up in Arabic. (Speaking in foreign language.) But I heard that they’re having a hard time retaining and recruiting Arabic linguists so that might not be very fair. But seriously, I do want to tell them, and I appreciate the opportunity to tell them, that the Army values and the lessons that I learned at West Point, honesty and courage and integrity, those are the things that we don’t just give those lip service. We actually act those out in our lives and in our duty and in our jobs. We can’t just talk about it like reading it in a book and that’s enough.

ROBERTS: Yes, that’s something I wanted to ask you about. Because you talked about this in Davis, California, the California Progress Report. It had some of the quotes of what you said there. One of them was “they are firing people from their units in a time of war when you need people to serve in their country. And these people are able, capable, willing, and trained. You’re firing them for the sole basis of who they are and the sole basis of their honesty. You learn that code of honor there at West Point.” And I’m wondering, how does the “don’t ask, don’t tell” policy fit in with that code of honor that was instilled in you at West Point?

CHOI: It absolutely does not fit in. And one of the most disgusting things that we see is the kind of threats that don’t ask don’t tell imposes on some of the soldiers that are honest, that are telling the truth about who they are. I’m facing an other than honorable discharge tomorrow morning simply for being honorable and saying who I am in truth. And that can really strip away a lot of the veterans’ benefits to include an education, home loan, and even veterans’ hospital and medical benefits. These benefits that I’ve earned by being a combat veteran of the Iraq war.

And so really what we’re seeing is in the face of these threats and in the face of so many immoral things, we go back on our training. And we see that having honor and having integrity, those things are important as officers, as leaders, and as Americans.

ROBERTS: At the same time, Lieutenant, you’re a member of an organization that is based on stringent rules, you broke those rules as they were written. Regardless of whether you think they’re fair or not, if you break the rules, should you suffer the consequences?

CHOI: We all know the consequences. And if you look at the risks and you take a look at what you’re up against, of course. It’s an informed decision, but more important than the consequences, more important than punishments or those fears that we might have, we take courage and we take those things very seriously of the values that we were taught. And it’s more important that we be honest with ourselves, we have integrity, and we have courage. Those are American values and they’re under assault because of immoral policies like “don’t ask, don’t tell.” Don’t ask…

ROBERTS: I was just going to say, do you have any hope that you’re not going to be discharged? Or are you just going to go there tomorrow to make a point?

CHOI: Well, I have a huge hope and a desire to continue serving in the military and, of course, whatever the outcome tomorrow, I’m going to work as hard as I can and continue marching for equality and the repeal of “don’t ask, don’t tell” and when that law does get repealed, I’ll raise my right hand one more time and I will say I’ll serve my country.

ROBERTS: All right. So just one more time, if you would for us, Lieutenant, the president has not moved on his campaign promise to repeal “don’t ask, don’t tell.” What do you have to say to the president this morning?

CHOI: Well, I think the time is now. We can’t wait to support our troops, we can’t wait to end immoral policies that really are an assault on everything that we stand for as Americans. So we shouldn’t wait one more day to stand up for American values.
