Judge Carter denies request, second amended complaint (9-23)

Judge Carter Keyes/Barnett v Obama grants the defense a limited stay of discovery until the motion to dismiss is ruled on. Same old thing. No discovery means no chance of the case moving forward. No way around standing and it’s unclear what Judge Carter will rule as far as subject matter jurisdiction. Only true chance was to have some type of preliminary discovery, which is what got people so excited about this case. Today is the first dose of reality. I suppose Taitz might be able to find something in the Motion to Dismiss but I see no reason to read through that again. The court date isn’t going to matter.

Defendants’ Motion to Dismiss, except any discovery as to which Plaintiff’s can demonstrate to Magistrate Judge Nakazato, is necessary to oppose the Motion to Dismiss.
