A date has been set for Roman Polanksi hearing – December 10 – in California’s 2nd District Court of Appeal.
What sparked his sudden arrest when he’s been out of France (won’t extradite) many times over the last three decades?
CNN questions whether the documentary on Polanski with the disgusting title: “Roman Polanski: Wanted and Desired,” might have set things off. The filmmakers, were trying to make a case for it to all go away, with the same old fairy tale that the admitted rapist was afraid he’d end up in jail for 50 years.
Questions about the judge – long dead Judge Laurence J. Rittenband – consulting another prosecutor not assigned to the case were brought up, as well as the judge allegedly planning on ignoring the plea agreement. No way it can ever be known and the coward took off before his day in court. It’s just a lame excuse.
In December 2008, on the heels of the documentary, Polanski’s legal team attempted to get a dismissal in the case.
Their strategy?
They claimed the LA DA’s office was not seeking extradition because they didn’t want to be held accountable for the documentary-alleged prosecutorial and judicial misconduct. Not a good idea…for Polanski.
Polanski lawyers’ July 7 filing:
The district attorney’s office, in the 30 years since Mr. Polanski left the jurisdiction, has not once sought to have him extradited. If it had, there would have been a hearing regarding misconduct in this case.
July 27 filing:
Combined with the fact that no effort has been made to extradite Mr. Polanski, the intent here is clear: invoke a physical absence which they caused and deliberately perpetuate in order to preserve the unconstitutional status quo and never address the misconduct head on.
What choice did the DA have?
In January 2009, the child Polanski raped – Samantha Geimer – came out in support of dropping the charges, which she has done before, including writing an op-ed in the LA Times in favor of allowing Polanski to go to the Oscars. Problem being, Polanski, by virtue of fleeing, has more charges: failure to appear and fleeing the jurisdiction.
And the reason Ms Geimer wants it all to go away (above and beyond her three sons reading her explicit grand jury testimony) was made perfectly clear with Whoopi Goldberg’s incredibly ignorant statements that “it wasn’t rape rape“.
